S.B. Criminal Misc. Petitions No. 35/2023 & 8919/2022:-

These criminal misc. petitions under Section 482 Cr.P.C. have been preferred for fair, expeditious and impartial investigation in FIR No.100/2022 registered at P.S. Ratanada, Jodhpur City East for the offences under Sections 380, 457 & 120-B IPC.

At the outset, learned Public Prosecutor submits that prima facie offence has been found to be made out against the sonMohhamed Jahid Ansari & daughter-in-law Smt. Iram Naj. The factual report furnished by learned Public Prosecutor is taken on record.

In light of such submission, the present petition is disposed of with liberty to the petitioners to take up all their legal issues before the learned trial court at appropriate stage, in case remaining. All pending applications also stand disposed of.

This criminal misc. petition under Section 482 Cr.P.C. has been preferred for quashing for FIR No.100/2022 registered at P.S. Ratanada, Jodhpur City East for the offences under Sections 380, 457 & 120-B IPC.

The parties are old mother, son and daughter-in-law.

At the outset, learned Public Prosecutor submits that prima facie offence has been found to be made out against the petitioners.

In the given factual matrix, the present petition is disposed of with liberty to the petitioners to submit their requisite bail bonds before the learned trial Court at the time of filing of the charge-sheet and the date of filing of the charge-sheet shall be informed by the investigating officer to the petitioners; in case they fails to do so, the learned trial court shall be free to proceed strictly in accordance with law. Further, the petitioners shall also have a liberty to take up all their legal issues, before the learned trial Court, at appropriate stage, in case so advised during trial.
