The present bail application has been filed under Section 438 Cr.P.C. in connection with FIR No.93/2020 registered at Police Station Mathuragate, District Bharatpur for the offence(s) under Sections 420, 406, 468 and 120B IPC.

Learned counsel for the petitioner submits that petitioner has been falsely implicated in this case. Previously, FIR was lodged against the petitioner in the year 2019. After that, charge sheet has been filed against the petitioner and trial court had convicted the accused on 2.2.2021 for the offence u/s 363, 366, 376(D)(A) IPC and trial court had not found proved the offence u/s 3/4 of POCSO Act. Sentence of the petitioner was suspended by Division Bench of this court on 16.3.2021. He also submits that petitioner can not be convicted for the same offence so present FIR is second against the petitioner. Petitioner is ready to join the

investigation. Nothing is to be recovered from the petitioner so petitioner be enlarged on anticipatory bail.

Learned Public Prosecutor has opposed the arguments advanced by learned counsel for the petitioner and submitted that petitioner created forged age certificate of the prosecutrix. Investigating Officer during investigation had investigated Dr. Lokendrapal Singh and he had clearly stated that he had not put his signature on the age certificate of the prosecutrix dt. 17.4.2019. Custodial interrogation of the petitioner is required so his bail be dismissed.

I have considered the arguments advanced by learned counsel for the petitioner as well as learned Public Prosecutor.

Allegation against the petitioner is that petitioner had created forged age certificate of the prosecutrix and solemnized marriage with her. As per the investigation, Dr. Lokendrapal Singh had not issued the said certificate by putting his signature on it. Custodial interrogation of the petitioner is also required so looking to the gravity of offence, I do not consider it a fit case to enlarge the petitioner on anticipatory bail.

Hence, the anticipatory bail application filed by the petitioner stands dismissed.
