The present bail application has been filed by the petitioner under Section 439 Cr.P.C. in connection with FIR No.854/2022 Registered at Police Station Pratap Nagar, Jaipur City (East) for the offence(s) under Sections 365, 376 IPC and Sections 3/4 of POCSO Act (later on offence(s) under Sections 363, 366-A IPC & Sections 7/8 of POCSO Act was found to have been made out).

Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case. He is behind the bars since 02.01.2023. Charge-sheet has been filed against the petitioner. Learned counsel for the petitioner further submits that a compromise has been arrived at between the parties and conclusion of trial may take long time. Hence, the petitioner may be enlarged on bail.

Learned GA-cum-AAG has opposed the bail application.

Considering the contentions put-forth by the counsel for the petitioner and taking into account the facts and circumstances of the case, without expressing any opinion on the merits and demerits of the case, this court deems it just and proper to enlarge the petitioner on bail.

Accordingly, the bail application under Section 439 Cr.P.C. is allowed and it is ordered that the accused-petitioner Deepak Sharma Son Of Satyanarayan be enlarged on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial court with the stipulation that he will appear before the trial court on all subsequent dates of hearing and as and when called upon to do so.
