The present bail application has been filed under Section 438 Cr.P.C. in connection with FIR No.494/2022 registered at Police Station Ramnagariya, Jaipur City (East) for the offence(s) under Sections 147, 149, 323, 341, 379, 457 and 504 IPC (later on offence under Sections 147, 149, 323, 341, 457, 379 and 506 IPC was found to have been made out).

Learned counsel for the petitioners submits that the petitioners have been falsely implicated in this case. The complainant who is a police constable and neighbour of the petitioner, misused his position and lodged false & frivolous FIR against the petitioner. Hence, the petitioner may be enlarged on anticipatory bail.

Learned Public Prosecutor has opposed the bail application.

Considering the contentions put-forth by the counsel for the petitioners and taking into account the facts and circumstances of the case and without expressing any opinion on the merits of the case, this court deems it just and proper to allow the anticipatory bail application.

Accordingly, the anticipatory bail application is allowed. The S.H.O/I.O/Arresting Officer, Police Station Ramnagariya, Jaipur City (East) in F.I.R. No.494/2022 is directed that in the event of arrest of the petitioners- (1) Arun Kumar Yadav S/o Shree Atar Singh Yadav and (2) Vikas Kumar S/o Shree Deepak Kumar Mishra , they shall be released on bail, provided each of them furnishes a personal bond in the sum of Rs.50,000/- with two sureties in the sum of Rs.25,000/- each to the satisfaction of the S.H.O/I.O/Arresting Officer of the concerned Police Station on the following conditions:-

(i) that the petitioners shall make themselves available for interrogation by a police officer as and when required;

(ii) that the petitioners shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the court or any police officer, and

¶24

(iii) that the petitioners shall not leave India without previous permission of the court.
