The instant bail application has been filed under Section 439 Cr.P.C. on behalf of accused-petitioners Nourat Singh and Suresh Yadav. The petitioners have been arrested in connection with FIR No.120/2021 dated 24.07.2021 registered at Police Station

Industrial Area Pali for the offence punishable under Section 420, 406, 467, 468, 471, 120-B IPC.

Learned counsel for the accused-petitioners submits that accused-petitioners have falsely been implicated in the case. The offence alleged against the accused-petitioners are triable by Magistrate. Accused-petitioners are in custody since the date of their arrest. Trial of the case will take long spell of time, therefore, no useful purpose would be served by keeping the petitioners behind the bars. He further submits that accused-petitioners Kuntal Goyal and Ramswaroop have already been enlarged on bail by the coordinate Bench vide order dated 01.05.2023 and case of accused-petitioners is not distinguishable from that of the accused Kuntal Goyal and Ramswaroop. It is also argued that the main allegation is against the accused Shambhoo Singh and Sanjeet Kumar and against them stay order has been granted under Section 482 Cr.P.C.

Learned Public Prosecutor vehemently opposes the bail application. 4. Considering the arguments advanced by learned counsel for the parties and looking to the overall facts and circumstances of the case, more particularly the fact that it is alleged in the FIR that while hacking the website of the complainant company accused Sanjeet Kumar and Shambhoo Singh have got the documents of the company and thereafter sold the property of the company to other persons. Role of accused-petitioners Nourat Singh and Suresh Yadav is not indicated in the FIR. Other accused persons Kuntal Goyal and Ramswaroop have already been enlarged on bail and case of the accused-petitioners are not

distinguishable from that of the accused Kuntal Goyal and Ramswaroop. Trial of the case may take long time. I deem it just and proper to grant bail to the accused-petitioners.

Accordingly, this bail application filed under Section 439 Cr.P.C. is allowed and it is ordered that accused-petitioners Nourat Singh S/o Kishan Singh & Suresh Yadav S/o Sh. Laxmi Narayan arrested in connection with FIR No.120/2021 dated 24.07.2021 registered at Police Station Industrial Area Pali shall be released on bail provided they furnishes a personal bond in the sum of Rs.50,000/- with two sound and solvent sureties of Rs.25,000/- each to the satisfaction of learned trial Judge for their appearance before the court concerned on all the dates of hearing as and when called upon to do so.
