Of India & Anr. reported in (2003) 2 SCC 45 observed that non-cooperation in judicial proceeding is not only punitive one, rather the Court is empowered to proceed in the listed judicial matters according to the law.

The present bail application has been filed under Section 438 Cr.P.C. in connection with FIR No.301/2022 registered at Police Station Khushkheda, District Police Bhiwadi, District Alwar for the offence(s) under Sections 143, 323, 341, 365, 384 and 34 IPC later on offence(s) under Sections 143, 323, 341, 342, 427, 308 and 506 IPC was found to have been made out).

Petitioner No.1- Jagdish Singh is present in person today in the Court and submits that he has been falsely implicated in this case. He further submits that a compromise has been arrived at between the parties. He has handed over original compromise to the Court Master of this Court, which is taken on record.

Learned Public Prosecutor has opposed the bail application.

Considering the contentions and taking into account the facts and circumstances of the case and without expressing any opinion on the merits of the case, this court deems it just and proper to allow the anticipatory bail application of petitioner No.1.

Accordingly, the anticipatory bail application qua petitioner No.1 is allowed. The S.H.O/I.O/Arresting Officer, Police Station Khushkheda, District Police Bhiwadi, District Alwar in FIR No.301/2022 is directed that in the event of arrest of the petitioner No.1- Jagdish Singh Son of Late Munshi Singh , he shall be released on bail, provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties in the sum of Rs.25,000/- each to the satisfaction of the S.H.O/I.O/Arresting Officer of the concerned Police Station on the following conditions:-

(i) that the petitioner No.1 shall make himself available for interrogation by a police officer as and when required;

(ii) that the petitioner No.1 shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the court or any police officer, and

¶22

(iii) that the petitioner No.1 shall not leave India without previous permission of the court.

Needless to mention here that the anticipatory bail application filed by the petitioner No.2 was dismissed as having

become infructuous by this Court vide order dated 14.02.2023 on
