The present 2^nd bail application has been filed by the petitioner under Section 438 Cr. P.C. in connection with FIR No.710/2022 registered at Police Station Kaman, Bharatpur for the offence under Sections 13 of the Rajasthan Public Gambling

I have perused the material available on record.

First bail application filed by the petitioner was dismissed as withdrawn by this Court vide order dated 07.02.2023 with liberty to the petitioner to surrender before the trial court. Instead of surrendering before the trial Court, the petitioner has filed the present second bail application under Section 438 Cr.P.C. which is not maintainable and it is accordingly dismissed.
