The petitioner apprehends arrest in connection with FIR No.112/2022 registered with Police Station Jaipur Airport, Jaipur City (East) for offences under Sections 420, 406, 467, 468, 471 and 120-B of IPC.

The informant entered into an agreement to purchase the referred plot from the petitioner on 20.11.2018. The petitioner was holder of Power of Attorney of real owner of the plot, namely Kishan Chand. The petitioner also produced original patta in the name of Kishan Chand. The agreement further discloses that possession over the plot to the purchaser was handed over along with the documents of the said plot. The FIR alleges that on 28.07.2022, the informant went to the said plot where Rajendra

Meena and others protested to give possession as they claimed that they had purchased the same.

Learned counsel for the petitioner submits that during investigation it surfaced that Kishan Chand had already died three moths prior to the date of agreement with the petitioner and on death of Kishan Chand the Power of Attorney lost its force, therefore, the petitioner had no authority to enter into agreement and knowingly entered into agreement with the informant just to cheat the informant, as consideration money was paid to the Bank Account of the petitioner.

Learned counsel for the petitioner contends that it is duty of the purchaser also to prima-facie satisfy himself about the title of the vendor, further if the legal heirs of Kishan Chand would have come to speak against the agreement between the parties, the matter would have been slightly different but if some other person is opposing the possession of the informant it would not be a case of dishonest intention on the part of the petitioner at the time of the agreement.

Considering the facts and circumstances of this case above, let the petitioner be released on anticipatory bail.

Accordingly, the instant anticipatory bail application stands allowed. It is directed that in the event of arrest or surrender within two weeks, the petitioner above-named shall be released on bail on furnishing bail bond of Rs.25,000/- with two sureties of like amount with following conditions:-

(i) that the petitioner shall fully cooperate with the investigation / trial of the case;

(ii) that the petitioner shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the court or any police officer, and

(iii) that the petitioner shall not leave India without prior permission of the Court.
