The present 5^th bail application has been filed by the petitioner under Section 439 Cr.P.C. in connection with FIR No.74/2020 Registered at Police Station Reengus, District Sikar for the offence(s) under Sections 420, 467, 468, 471, 406 and 120-B IPC.

Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case. He is behind the bars since 16.03.2020. Charge-sheet has been filed against the petitioner. Learned counsel for the petitioner further submits that similarly situated co-accused Hasibur Rahman has been enlarged on bail by the Co-ordinate Bench of this Court vide order dated 18.07.2022 in S. B. Criminal Miscellaneous 4^th Bail Application No.2372/2022. The alleged offence is triable by a Judicial

Magistrate, First Class. Learned counsel for the petitioner also submits that during trial, witnesses namely Hansraj (PW-6) Mahendra Singh (PW-7) and Maan Singh Yadav (PW-8) have been examined. In their statements they clearly stated that Hasibur Rahman and Arun Sharma had taken money from them. Conclusion of trial may take long time. Hence, the petitioner may be enlarged on bail.

Learned Public Prosecutor has opposed the 5^th bail application.

Considering the contentions put-forth by the counsel for the parties and taking into account the facts and circumstances of the case, without expressing any opinion on the merits and demerits of the case, this court deems it just and proper to enlarge the petitioner on bail.

Accordingly, the 5^th bail application under Section 439 Cr.P.C. is allowed and it is ordered that the accused-petitioner Jaina Amulya Kumar S/o Late Daitar Jaina Amulya be enlarged on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial court with the stipulation that he will appear before the trial court on all subsequent dates of hearing and as and when called upon to do so.
