This application has been filed by the petitioner under Section 482 Cr.P.C. for recalling the order dated 17.03.2023.

Learned counsel for the petitioner submits that the 4^th bail application filed by the petitioner was dismissed by this Court vide order dated 13.09.2022. After that, petitioner filed fresh bail application before the trial court and trial court vide order dated 03.03.2023 dismissed the bail application filed by the petitioner. After that, petitioner filed the 5^th bail application before this Court but inadvertently vide order dated 17.03.2023, the 5^th bail application was not decided on merits and direction was given to first approach the trial court, whereas petitioner had already approached the trial court and trial court had dismissed the bail application filed by the petitioner.

In this view of the matter, the order dated 17.03.2023 passed by this court is recalled. Office is directed to re-register the criminal miscellaneous 5^th bail application No.3064/2023.
