This application for bail under Section 439 Cr.P.C. has been filed by the petitioner who has been arrested in connection with F.I.R. No.113/2022 registered at Police Station Rawatsar, District Hanumangarh for the offence punishable under Sections 450, 376D and 306 read with Section 34 IPC. Learned counsel for the petitioner submitted that after making thorough investigation, the investigating agency has filed charge-sheet before competent criminal court on 29.4.2022 against the present petitioner. Learned counsel submitted that as per the charge-sheet, on 2.3.2022 petitioner alongwith co-accused Sandeep Kumar committed rape upon deceased and also pressurised her to make illicit relations with co-accused Shashipal. humiliating behaviour and act of the petitioner, the deceased committed suicide by jumping in a pond ( Kund ).

Learned counsel for the petitioner vehemently submitted that co-accused Sandeep Kumar and Shashipal have already been enlarged on bail by the coordinate Bench of this Court vide order dated 2.8.2022 passed in CRLMB No.7585/2022 and 8631/2022 respectively. Learned counsel for the petitioner submitted that the case of the present petitioner is not distinguishable from that of the co-accused, therefore, he also deserves to be enlarged on bail.

Learned counsel vehemently submitted that the FSL report prepared by the State Forensic Science Laboratory Rajasthan, Jaipur did not indicate that any male semen was detected on the clothes worn by the deceased. Learned counsel submitted that in the charge-sheet, there is no evidence against the petitioner of instigating or abetting the deceased to commit suicide. Learned counsel for the petitioner submitted that the petitioner has been falsely implicated in the present case; challan has already been filed and trial is likely to take sufficiently long time and hence, the petitioner deserves to be enlarged on bail.

Per contra, learned Public Prosecutor has opposed the bail application.

Heard learned counsel for the petitioner as also the learned Public Prosecutor and perused the material available on record.

Having considered the submissions advanced at the bar and having gone through the facts and circumstances of the case so also the FSL report and also looking to the fact that the coaccused persons have already been enlarged on bail by coordinate

Bench of this Court, in the opinion of this Court, the petitioner too deserves to be enlarged on bail.

Consequently, the bail application under Section 439 Cr.P.C. is allowed. It is ordered that the accused-petitioner - Ranjeet Singh @ Sunny S/o Rampal arrested in connection with F.I.R. No.113/2022 registered at Police Station Rawatsar, District Hanumangarh shall be released on bail, if not wanted in any other case, provided he furnishes a personal bond of Rs.50,000/- and two sureties of Rs.25,000/- each, to the satisfaction of learned trial court, for his appearance before that court on each & every date of hearing and whenever called upon to do so till completion of the trial.
