A communication has been received from the Additional Sessions Judge No.4, Jodhpur Metro inter alia indicating that the appellant had not appeared in the month of January, 2023 for marking his presence in terms of the directions issued by this Court and the counsel for the appellant indicated that the appellant has died, on which, a factual report was sought from the SHO, Police Station, Phalodi, Jodhpur, who has reported that the appellant has died on 28.3.2022. A copy of the death certificate has also been annexed with the said communication.
In view of the above fact situation, the appeal is dismissed as having abated.
