Matter comes up on an applications (I.A. No.1/2023) u/s 151 CPC filed by the applicant for sending back the record of this case to the tribunal.

Application is allowed for the reasons mentioned therein.

Office is directed to send back the record to the tribunal.

Learned counsel for the applicants submits that the applicant- Sharwan Lal Sharma had filed SBCMA No. 3211/2022 before this court which was disposed of vide order dt. 12.4.2023 with a direction to him to file an application under Order 9 Rule 13 CPC before the tribunal. Pursuant thereto, he has filed an

application under Order 9 Rule 13 CPC before the tribunal for setting aside the ex-parte decree.

Learned counsel for the appellant-Insurance Company submits that appeals filed by the Insurance Company be disposed of with a liberty to file a fresh appeal, if occasion so arises, after the decision of the application under Order 9 Rule 13 CPC filed by the applicant.

So, appeals filed by the Insurance Company are disposed of accordingly.

Since, the present appeals have not yet been admitted, cross objection filed by the claimant also stands disposed of accordingly.

¶45

However, claimant would be at liberty to avail appropriate remedy, if occasion so arises.

Tribunal is directed to decide the application under Order 9 Rule 13 CPC independently without being prejudice by its judgment dt. 26.8.2009.
