The petitioner seeks temporary bail on the ground of death of his father Shri Narayan. Some treatment documents have been annexed with this application which indicate that Shri Narayan, aged 74 years, was undergoing treatment in the Government Hospital, Pratapgarh.

Learned Public Prosecutor has placed on record the letter received from SHO PS Dhamotar as per which, Shri Narayan expired on 28.02.2022. However, the Sarpanch concerned refused to issue the death certificate.

Be that as it may. Since the appellant’s father has passed away as per the verification report submitted on record by learned Public Prosecutor, it is considered just and expedient in the

interest of justice to grant interim bail to the appellant so that he can perform social rituals pursuant to the death of his father.

Accordingly, the instant application for temporary suspension of sentences is allowed and it is hereby directed that the sentences awarded to the applicant-appellant Tulsi Ram S/o Shri Narayan shall remain suspended and he shall be released on temporary bail for a period of fifteen days from the date of his release provided he furnishes a personal bond in the sum of Rs.80,000/- with two sound and solvent sureties in the sum of Rs.40,000/- to the satisfaction of Superintendent, Central Jail, Udaipur. The Superintendent, Central Jail, Udaipur shall give the date of surrender to the appellant as per the date on which he is released from custody. Needless to say that after completion of the aforesaid period, the applicant-appellant shall surrender before the concerned jail authorities.
