Heard. Perused the material available on record.
The petitioner has been denied pertinent parole on the ground that he has been convicted for prohibited/restricted offence and hence, is not entitled to be considered for such relief in light of the Rajasthan Prisoners Release on Parole Rules, 2021 (hereinafter referred to as ‘the Rules of 2021’).
Learned counsel Shri Kaluram Bhati, vehemently and fervently urged that the application for grant of permanent parole was filed on behalf of the convict petitioner prior to coming into force of the Rules of 2021. However, such plea is not correct in

view of the pleadings of the writ petition wherein, it is clearly mentioned that the application for grant of permanent parole was filed by the petitioner on 24.09.2021. Thus, we are of the view that the rejection of the application filed by the convict petitioner for grant of permanent parole, is absolutely justified as the same is in consonance with the Rules of 2021.
Accordingly, the writ petition is dismissed as being devoid of
merit.
