Shri Harish Kumar Purohit submits that as fresh grounds having raised in this appeal which were not taken in the writ petition filed before the learned Single Bench, he may be allowed to withdraw the same with liberty to the petitioner to file a review application before the learned Single Bench. His only submission is that bar of limitation may not come in the way of petitioner and the period for which this appeal has been pending, may be excluded while calculating limitation for review.
Shri Anil Kumar Gaur does not oppose this prayer.

Thus, the instant special appeal writ is disposed of as withdrawn giving liberty to the petitioner to file a review application before the learned Single Bench. Subject to the application for review being filed within next 30 days, the time period taken during the pendency of this appeal shall be excluded when limitation is calculated.
