The matters come upon applications under Article 226(3) of the Constitution of India for vacation of the interim orders dated 04.09.2020 and 25.01.2021 respectively, vide which the direction of the Tribunal to the extent of award of interest was stayed.

It has been submitted that the order dated 28.03.2014 which is under challenge in the present petitions had been challenged by the petitioner Society earlier too in S.B. Civil Writ Petition No.4738/2014 and the said fact has totally been concealed in the present petitions. It has therefore, been prayed that the interim orders be vacated, the same being passed in ignorance of the earlier writ petition.

During the course of the arguments, learned counsel for the petitioners-Institute prayed for withdrawal of the present writ petitions.

In the facts and circumstances of the case, permission as prayed for is granted.

¶29

As a consequence, the writ petitions as well as the stay applications stand dismissed and the interim orders automatically stand vacated.

All the pending applications also stand disposed of.
