Heard. Perused the material available on record.

The convict-petitioner Omprakash @ Vishnu S/o Shri Punamaram was granted first parole of twenty days by virtue of this Court’s order dated 22.07.2021 passed in D.B. Criminal Writ Petition No.502/2020. By this order, the convict petitioner was required to furnish a personal bond in the sum of Rs.1,00,000/with two sound and solvent sureties of Rs.50,000/- each (of which one shall be furnished by the petitioner’s father Shri Punma Ram) to the satisfaction of Superintendent, Central Jail, Jodhpur. The convict petitioner has forwarded this writ petition from Jail praying that the condition of furnishing two sureties may be relaxed.

Shri Anil Joshi, learned GA-cum-AAG (In-Charge) has submitted the family status report of the convict-petitioner, as per which the financial position of the family of the convict prisoner is normal.

Thus, keeping in view the overall facts and circumstances of the case, we feel that the prayer of the convict that he may be released on first parole of twenty days on personal bond only cannot be accepted. However, on humanitarian consideration, the requirement of furnishing two sound and solvent sureties is modified and instead it is directed that the petitioner Omprakash S/o Shri Punamaram shall be released on first parole of twenty days upon furnishing a personal bond in the sum of Rs.1,00,000/with one surety of Rs.50,000/- to the satisfaction of the Superintendent Central Jail, Jodhpur. However, the other conditions of the order dated 22.07.2021 shall be maintained.

With this modification in the order dated 22.07.2021 passed in D.B. Criminal Writ Petition No.502/2020, the writ petition is disposed of.
