The present petition has been preferred by the petitioners under Section 482 of Cr.P.C. for quashing of FIR No.03/2021 lodged at Police Station Sujangarh, District Churu for the offence under Sections 498-A, 406 & 323 of IPC.

Learned counsel for the petitioners has vehemently tried to make out a case that out of the matrimonial vindictiveness, the present allegations have been levelled.

Learned Public Prosecutor, however, submits that the investigation is complete and prima facie, offence has been found

to be made out. Learned Public Prosecutor further submits that the conclusion is ready to be filed before the learned trial court.

Learned Public Prosecutor alongwith Investigating Officer further submits that there is no requirement of arrest at this stage.

Learned counsel for the complainant opposes the submissions.

This Court, after taking into consideration the record of the case as well as the submissions made, deems it appropriate to dispose of the present petition with liberty to the petitioners to take up all their legal issues at appropriate stage before the learned trial court.

It is needless to say that whenever the charge sheet is to be filed, the petitioner shall be informed in regard thereto, and the petitioner in turn, shall be required to cooperate in the proceedings and shall also be permitted to submit the requisite bail-bonds; in case he fails to do so, the learned trial court shall be free to proceed strictly in accordance with law.

The factual report produced by learned Public Prosecutor is taken on record.

All pending applications stand disposed of.
