After hearing the learned counsel for the parties and perusing the FIR as well as factual report submitted by the learned Public Prosecutor, I am not inclined to quash the FIR or interfere in the course of investigation. However, considering the submissions that the petitioner was not in direct contact with the complainant, he purchased the property subsequently and was a bona fide purchaser, this Court deem it appropriate that he shall not be arrested during the course of the investigation and in the event of filing of charge sheet, he shall be intimated to appear before the concerned Court.

Upon submission of the charge sheet, if the petitioner appears and moves for a regular bail application, he shall be released upon furnishing the bail bonds as the learned Magistrate concerned thinks fit.
