Heard learned counsel for the parties and perused the FIR impugned.

A bare perusal of the FIR revealing elements of swindling the complainant as a consequences thereof the complainant has incurred huge loss. It is further revealed that there is commission of cognizable offence which is required to be investigated.

Till date, the investigation reveals complicity of the petitioner in commission of crime, thus, this Court is not supposed to embark upon an enquiry so as to examine the genuineness of the

allegation leveled in the FIR, prima facie case is made out against the petitioner. There is no force in the misc. petition.

Accordingly, misc. petition is dismissed.

Stay petition is also dismissed.
