Mr. Singhal, submits that the petitioner would be better advised to submit all his defences before the trial court at the appropriate stage of proceedings and that the trial court would be better placed to appreciate these defences which have been presented in this petition under Section 482 Cr.P.C. for the first time.
In view of the statement made above, the petitioner is given liberty to appear before the trial court and to raise all his permissible defences at the appropriate stage of trial.
With the above observations, the misc. petition is disposed of as withdrawn.
