The present bail application has been filed under Section 438 Cr.P.C. in connection with FIR No.136/2016 registered at Police Station Raini, District Alwar for the offence(s) under Section 363, 366, 376D of IPC & 5(g)/6 of POSCO Act.

Learned counsel for the accused-applicants has submitted that co-accused Mahesh Chand and Smt. Varsha Devi have already been granted anticipatory bail vide order dated 25.05.2022. He submitted that initially, in the investigation, no case was made out against the applicant. It was only under Section 319 that the accused-applicant was impleaded as a party. Learned counsel has also relied upon order dated 30.07.2022,

vide which one of the co-accused, Mr. Krishna Kumar Meena, against whom charge-sheet was filed, has been acquitted.

Learned Public Prosecutor has opposed the bail application. 4. Considering the facts and circumstances of the case, arguments advanced by both the sides, but without commenting on the merits or demerits of the case, this court deems it fit to grant anticipatory bail to the accused-applicants and directs them to appear before the learned trial court and participate in the proceedings whenever required.

Accordingly, the anticipatory bail application is allowed. The S.H.O/I.O/Arresting Officer, Police Station Raini, District Alwar in F.I.R. No.136/2016 is directed that in the event of arrest of the applicants- (1) Dinesh Son Of Lakhan Lal (2) Namo Narayan @ Nabbi Son Of Shri Hemraj (3) Narendar Son Of Shri Govind Sahai they shall be released on bail, provided they furnish a personal bond in the sum of Rs.50,000/- with two sureties in the sum of Rs.25,000/- each to the satisfaction of the S.H.O/I.O/Arresting Officer of the concerned Police Station on the following conditions:-

(i) that the applicants shall make themselves available for interrogation by a police officer as and when required;

(ii) that the applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the court or any police officer, and

(iii) that the applicants shall not leave India without previous permission of the court.
