The instant bail application has been filed under Section 439 Cr.P.C. on behalf of accused-applicant. The accused-applicant was arrested in connection with FIR No. 114/2022 registered at Police Station Reni District Alwar for the offence(s) under Sections 457, 380, 376(2)(n) of IPC and Section 67 of IT Act.

Learned counsel for the accused-applicant submits that admittedly in the FIR, it is reported that the victim was in close company of accused-applicant for last five years. The complainant has also admitted in the FIR that blackmailing on account of certain pictures, was also done by the accused-applicant since past five years. Learned counsel further submits that FIR was filed at belated stage. Accused-applicant is of 22 years. He has been falsely implicated in the matter on account of certain

misunderstanding. There is no criminal antecedent against the accused-applicant.

Per contra , learned Public Prosecutor has vehemently opposed the bail application. His additional submission is that offence is grave in nature.

I have heard the arguments advanced by the counsel for the parties. Considering the fact that as per record victim is of 39 years of age and accused-applicant is a young man of 22 years, they were in close company since past five years, chargesheet has been filed, trial will take time and looking to the overall facts and circumstances of the case and material on record but without commenting on merits and demerits of the case, this court is inclined to enlarge the accused-applicant on bail.

Accordingly, the bail application under Section 439 Cr.P.C. is allowed and it is ordered that accused-applicant Surendra Kumar Alias Sundi Meena S/o Shri Ramratan Meena, shall be enlarged on bail provided he furnishes a personal bond of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of learned trial Judge for his appearance before the court concerned on all the dates of hearing as and when called upon to do so.
