This bail application under Section 439 Cr.P.C. is laid by petitioner in connection with an FIR No.163/2022, Police Station Kotegate, District Bikaner, wherein he is charged for offences punishable under Sections 8/21 and 22 of the NDPS Act.
Learned counsel for the petitioner submits that the recovered contraband is below commercial quantity and the accusedpetitioner has falsely been implicated in this case. Learned counsel further submits that the petitioner is behind the bars since long. It is also submitted that trial of the case will take sufficient time and therefore, the petitioner may be enlarged on bail.
Learned Public Prosecutor has opposed the bail application and submits that the accused-petitioner is a habitual offender.
Having heard learned counsel for the parties and without expressing any opinion on merits of the case, I deem it just and appropriate to release the petitioner on bail.

Accordingly, the bail application under Section 439 Cr.P.C. is allowed and it is ordered that accused-petitioner Sunil S/o Bhanwarlal, arrested in connection with F.I.R. No.163/2022, Police Station Kotegate, District Bikaner, may be released on bail; provided he furnishes a personal bond of Rs.1,00,000/- with two surety bonds of Rs.50,000/- each to the satisfaction of learned trial Court with the stipulation to appear before that Court on all dates of hearing and as and when called upon to do so.
