The present bail application has been filed under Section 438 Cr.P.C. in connection with FIR No.124/2022 registered at Police Station Khairthal (Bhiwadi) District Alwar for the offence(s) under Sections 420 and 406 IPC.

Learned counsel for the accused-applicant submits that dispute in question is of civil nature. Initial FIR numbering 252/2022 at Police Station Khairthal (Bhiwadi), was filed by the Padam Kumar against the accused-applicant for offence under Section 420 read with Section 406 of IPC. After due investigation, a final report was given. Thereafter, present complainantBhagwan Das, has filed complaint against the accused-applicant on 23.02.2022 and both of them are relatives. The present complaint has been filed only to pressurize the accused-applicant.

Learned Public Prosecutor has opposed the bail application.

Considering the contentions put-forth by the counsel for the parties and that the matter involves a civil flavour, FR has been filed in one FIR lodged by relative of present complainant and that the present FIR is filed with an intention to pressurize the accused-applicant but without expressing any opinion on the merits or demerits of the case, this court deems it just and proper to allow the anticipatory bail application.

Accordingly, the anticipatory bail application is allowed. The S.H.O/I.O/Arresting Officer, Police Station Khairthal (Bhiwadi) District Alwar in F.I.R. No. 124/2022 is directed that in the event of arrest of the accused-applicant Nawab Son Of Shri Himmat , he shall be released on bail, provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties in the sum of Rs.25,000/- each to the satisfaction of the S.H.O/I.O/Arresting

Officer of the concerned Police Station on the following conditions:-

(i) that the petitioner shall make himself available for interrogation by a police officer as and when required;

(ii) that the petitioner shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the court or any police officer, and

(iii) that the petitioner shall not leave India without previous permission of the court.
