The present bail application has been filed under Section 438 Cr.P.C. in connection with FIR No.2/2022 registered at Police Station Sadar Deeg, District Bharatpur for the offence(s) under Sections 143, 323, 341 and 354 of IPC.

Learned counsel for the applicants submit that vide order dated 13.05.2022, an interim protection from arrest was granted, subject to applicants joining investigation. The said fact is not refuted by the learned Public Prosecutor. Counsel for the applicants has also placed on record the report of the Medical Officer whereby, it is reflected that Ram Khiladi who was stated to be injured by the applicants is having simple injuries. The case in hand pertains interse to dispute between neighbours regarding

construction of wall. No criminal antecedents exist against the accused-applicants. Co-accused has already been enlarged on bail vide order dated 18.05.2022 by Coordinate Bench of this Court.

Learned Public Prosecutor has submitted that after passing of the said order, the applicants have joined the investigation and cooperated with the authorities. The case in hand was registered under Section 143, 323, 341 and 354 of IPC. 4. Considering the fact that the applicants have joined investigation as directed, the interim protection is made absolute. 5. Accordingly, the anticipatory bail application is allowed. The S.H.O/I.O/Arresting Officer, Police Station Sadar Deeg, District BHaratpur in F.I.R. No.2/2022 is directed that in the event of arrest of the applicants- 1. Omvir Son Of Shri Babulal and 2. Mahesh Son Of Shri Babulal , they shall be released on bail, provided each of them furnishes a personal bond in the sum of Rs.50,000/- with two sureties in the sum of Rs.25,000/- each to the satisfaction of the S.H.O/I.O/Arresting Officer of the concerned Police Station on the following conditions:-

(i) that the applicants shall make themselves available for interrogation by a police officer as and when required;

(ii) that the applicants shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the court or any police officer, and

(iii) that the applicants shall not leave India without previous permission of the court.
