After arguing the matter for quite some time, learned counsel for the petitioner stated that he does not want to press the present bail application at this stage but seeks liberty for the accused-petitioner to file fresh bail application after recording of the statement of the Seizure Officer.

Accordingly and in view of the submissions made hereinabove, the instant bail application filed under Section 439 Cr.P.C. on behalf of the accused-petitioner, Shaitanaram S/o Arjunram , is dismissed as not pressed with liberty as prayed for.

However, looking to the period of judicial custody of the accused-petitioner and as requested by the learned counsel for the petitioner, the Trial Court concerned is directed to record the statement of the Seizure Officer, as a first witness, on priority basis.
