Learned counsel for the petitioner stated that he does not want to press the present bail application but seeks liberty for the accused-petitioner to file fresh bail application after recording of the statement of Seizure Officer (Bhanwarlal) and the witnesses, namely, Gena Ram S/o Hidaji and Achala Ram S/o Harjiji. Learned counsel further requested that a direction may be issued to the learned Trial Court to record the statements of the above named witnesses on priority basis.

Accordingly and in view of the submissions made hereinabove, the instant bail application filed under Section 439 Cr.P.C. on behalf of the accused-petitioner, Sawai S/o Jetharam , is dismissed as not pressed with liberty as prayed for.

As requested by the learned counsel for the petitioner, the Trial Court is directed to record the statements of the abovementioned witnesses on priority basis.
