The present interim bail application has been filed under Section 439 Cr.P.C. on behalf of the accused-petitioner, who is in custody in connection with F.I.R. No.606/2021, Police Station Sanchore registered for the offence punishable under Sections 8/18, 25 & 29 of the NDPS Act.

Learned counsel appearing on behalf of the applicantpetitioner stated that the present interim bail application has been filed on behalf of the petitioner on the ground that marriage of his daughter is going to be solemnized on 11.05.2022. It is further submitted that to perform the religious rites and other ceremonial functions, the presence of father of the daughter would be required, therefore, interim bail for a limited period may kindly be granted to the accused-petitioner.

Per contra, learned Public Prosecutor opposing the interim bail application of the accused-petitioner.

Considering the overall facts and circumstances of the case, this Court is of the opinion that the interim bail application for a period of 15 days deserves to be allowed.

Accordingly, the instant interim bail application is allowed and it is ordered that the accused-petitioner, Gori Lal S/o Shri Bihari Lal, shall be released on interim bail for a period of 15 (Fifteen) days, in connection with F.I.R. No.606/2021, Police Station Sanchore, from the date of his actual release, provided he furnishes a personal bond in the sum of Rs.2,00,000/- and two surety bonds in the sum of Rs.1,00,000/- each to the satisfaction of the concerned Jail Authorities.

The concerned Jail Authorities shall be at liberty to impose any other terms and conditions for ensuring surrender of the accused-petitioner into the prison after expiry of period of interim bail being granted under this order.
