The present bail applications have been filed under Section 439 Cr.P.C. The petitioners have been arrested in connection with FIR No.246/2021 Police Station Boranada, District Jodhpur for the offences punishable under Section 302/34 of IPC.

Learned counsel for the petitioners submits that no specific role has been assigned to the present petitioners and in the FIR,

name of accused Mehraj Khan and Dumpy @ Rehman have been specifically mentioned but later on, on the basis the CCTV footage, the police arrested five more accused persons who caused injuries to the deceased. He further submits that the so called eyewitnesses Babulal and Jahangir both have been examined before the Court and they denied the fact that these accused-petitioners caused any injuries to the deceased. The trial of the case will take sufficient long time to be concluded. Therefore, the benefit of bail should be granted to the accused-petitioners.

Learned Public Prosecutor opposed the bail applications.

I have considered the arguments advanced before me and gone through the material available on record.

As per First Information Report, specific name of present petitioners Mehraj Mansoor and Dumpy @ Rehman have been mentioned and after investigation, Police on the basis of CCTV footage, arrested five accused persons along with Sohel Khan. Furthermore, bail applications of similarly situated co-accused Sunil and Aasin Khan have been dismissed by the co-ordinate Bench of this Court. Therefore, no case for grant of bail is made out.

Hence, the present bail applications filed by the petitioners are hereby dismissed at this stage.
