This anticipatory bail application has been filed by the petitioner apprehending his arrest in connection with the FIR No.39/2020, Police Station Chittorgarh Sadar, District Chittorgarh for the offence under Sections 341, 323, 325, 307/34 of IPC.
Learned counsel for the petitioner submits that the firstly the Investigating Officer did not make the present petitioner as an accused but later on the Police want to arrest the petitioner. Counsel further submits that no specific allegation has been levelled against the petitioner. In these circumstances, bail may be granted to the petitioner.
Learned Public Prosecutor opposed the bail application.
I have considered the arguments advanced before me and gone through the material available on record.
According to the statement of injured Mahendra Singh, a specific allegation for causing injury on his head by sword has

been assigned to the present petitioner and as per the X-Ray report the injury recieved by injured Mahendra Singh is found to be grievous in nature and dangerous to life also, therefore, no case for grant of bail under Section 438 Cr.P.C. is made out. Hence, the bail application filed by the petitioner is hereby rejected.
