This bail application under Section 439 Cr.P.C. is laid by petitioner in connection with an FIR, wherein they are charged for offences punishable under Sections 420, 406, 467, 468, 471 and 120B IPC.

Learned counsel appearing for the petitioners submits Vikram Singh and Heer Singh were the attesting witnesses and offences alleged against the petitioners are triable by Magistrate. It is also submitted that no recovery is to be made from them and the conclusion of the trial would take time. Further, it is submitted that all the three accused-petitioners are behind the bars since long and out of them one is lady. Therefore, they may be released on bail.

Learned Public Prosecutor opposed the bail.

Having heard learned counsel for the parties and considering the fact that offence(s) is/are triable by Magistrate, without expressing any opinion on merits of the case, I deem it just and appropriate to grant indulgence to the petitioners by enlarging them on bail.

Accordingly, the bail applications under Section 439 Cr.P.C. are allowed and it is ordered that accused-petitioners (1) Vikram Singh S/o Shiv Singh (2) Smt. Seema W/o Mahesh and (3) Harisingh @ Hirasingh S/o Govind Singh arrested in connection with F.I.R. No.280/2021, Police Station Rajnagar, District Rajsamand may be released on bail; provided they furnish personal bonds of Rs.1,00,000/- each with two surety bonds of Rs.50,000/- to the satisfaction of learned trial Court with the
