Apprehending his arrest in connection with FIR No. 362/2021 registered at Police Station Sapotara, District Karauli for the offence(s) under Sections 323, 341, 379, 354, 342, 427, 451 & 143 of IPC. The petitioner has preferred this anticipatory bail application under Section 438 of Cr.P.C.

Learned counsel for the accused-petitioners submits that the accused-petitioners have been falsely implicated in this case. Since the petitioner No. 1 Suresh has been arrested in the matter. Thus, the anticipatory bail application filed by him becomes infructuous. They are ready to cooperate with the investigation. Custodial interrogation is not required.

Learned Public Prosecutor has vehemently opposed the bail applications.

Having considered the overall allegations leveled in the FIR and contentions made by the counsel for the accused-petitioner.

Taking into account the totality of facts and circumstances of the case and without expressing any opinion on the merits of the case, this court deems it just and proper to allow the anticipatory bail application.

Accordingly, the anticipatory bail application is allowed. The S.H.O/I.O/Arresting Officer, Police Station Sapotara, District Karauli in F.I.R. No. 362/2021 is directed that in the event of arrest of the petitioners- Suresh S/o Maddu, Hanuman S/o Felu & Smt. Samay Bai W/o Suresh they shall be released on bail, provided each of them furnishes a personal bond in the sum of Rs.50,000/- with two sureties in the sum of Rs.25,000/- each to the satisfaction of the S.H.O/I.O/Arresting Officer of the concerned Police Station on the following conditions:-

(i) that the petitioners shall make himself available for interrogation by a police officer as and when required;

(ii) that the petitioners shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the court or any police officer, and

(iii) that the petitioners shall not leave India without previous permission of the court.
