Learned counsel for the appellants prays for withdrawal of the criminal appeal with liberty to file fresh one after statements of prosecution witnesses namely Rajendra Kumar and Prem Bai are recorded in the trial.
The prayer sought for is allowed.
Accordingly, the criminal appeal is dismissed as withdrawn with liberty as prayed for.
The learned trial Court shall make sincere endeavor to record the statements of prosecution witnesses namely Rajendra Kumar and Prem Bai preferably within a period of two months from the date of receipt of certified copy of this order.
