This bail application under Section 439 Cr.P.C. has been filed by petitioner in connection with FIR No.740/2022 registered at Police Station Mathuragate, District Bharatpur wherein he is charged for offences punishable under Sections 457, 380, 435 & 120-B of I.P.C.

Learned counsel for the petitioner submits that the alleged offences are triable by Magistrate and after investigation, charge sheet has been submitted and conclusion of the trial will take its own time, so indulgence of bail may be granted to him. Counsel submits that petitioner is not having any criminal antecedents.

Per contra, learned Public Prosecutor opposed the bail application.

Considering the arguments put forward by learned counsel for the petitioner and looking to the facts that the alleged offences are

triable by the Magistrate and trial will take its own time to conclude but without expressing any opinion on merits or demerits of the case, I deem it just and appropriate to grant indulgence of bail to the petitioner under Section 439 Cr.P.C.

Accordingly, the bail application under Section 439 Cr.P.C. is allowed and it is ordered that accused-petitioner Gulam Sabir S/o Ijrayal Khan , may be released on bail; provided he furnishes a personal bond of Rs.50,000/- with two surety bonds of Rs.25,000/each to the satisfaction of learned trial Court with the stipulation to appear before that Court on all dates of hearing and as and when called upon to do so.
