This bail application under Section 439 Cr.P.C. has been filed by petitioner in connection with FIR No327/2022 registered at Police Station Mahaveer Nagar, District Kota City wherein he is charged for offences punishable under Sections 376(2)(N) & 506 of I.P.C.

Learned counsel for the petitioner submits that the prosecutrix is major lady of 24 years and for the incident occurred in the year 2019 and on all subsequent dates, a delayed report has been lodged on 18.04.2022. Counsels submits that the prosecutrix stayed with the petitioner in a hotel of her own will on 04.04.2021 and the instant case is a case of consent, which has been given a colour of rape and subsequently a delayed report has been lodged after a lapse of long time. Counsel submits that the petitioner is in custody since 07.08.2022 and after investigation, charge sheet has

been submitted and conclusion of the trial will take its own time to conclude, so indulgence of bail may be granted to him.

Per contra, learned Public Prosecutor opposed the bail application.

Considering the arguments put forward by learned counsel for the petitioner and looking to the fact that the prosecutrix is a major lady of 24 years and for the incident occurred in the year 2019 and on subsequent dates, a delayed report has been lodged on 18.04.2022, without expressing any opinion on merits or demerits of the case, I deem it just and appropriate to grant indulgence of bail to the petitioner under Section 439 Cr.P.C.

Accordingly, the bail application under Section 439 Cr.P.C. is allowed and it is ordered that accused-petitioner Ajayraj Singh S/o Shambhusingh , may be released on bail; provided he furnishes a personal bond of Rs.50,000/- with two surety bonds of Rs.25,000/- each to the satisfaction of learned trial Court with the stipulation to appear before that Court on all dates of hearing and as and when called upon to do so.
