The petitioner has preferred the present writ petition with a grievance that the respondent No.2 and 3 have not issued caste certificate to the petitioner, though she is already having a caste certificate dated 16.07.2010 in her name so also a certificate dated 31.07.1987 in the name of her father.

Mr. Vij, learned counsel for the respondents has raised an objection that the petitioner has not placed on record a copy of the application and contended that the petitioner has not even applied for the caste certificate.

Without going into the dispute as to whether the petitioner has submitted an application for issuance of caste certificate or not, the present writ petition is disposed of with a direction to the petitioner to file a fresh application for grant of caste certificate alongwith the certified copy of the order instant and relevant documents before the competent authority-respondent No.2 and 3 within a period of seven days from today.

It will be required of the competent authority to consider petitioner’s application in accordance with law and in light of her representation within a period of seven days from receipt of the application.

In case, the competent authority is of the view that the petitioner is not entitled for the caste certificate as demanded, he shall pass a speaking order indicating therein the reasons for the same under intimation to the petitioner, against which the petitioner’s right to take legal remedies shall stand reserved.

It is made clear that aforesaid direction to decide the petitioner’s representation has been issued only with a view to ensure expeditious redressal of petitioner’s grievance. The same may not be construed to be an order to decide the representation in a particular manner.

The stay application also stands disposed of accordingly.
