The present Criminal Misc. Petition has been filed for quashing of F.I.R. No.119/2019 registered at Police Station Salumbar District Udaipur for the offences under sections 420 and 406 of IPC.

Learned counsel for the petitioner submits that though statement was made on 07.04.2021 before this court that police after thorough investigation has filed the challan against the petitioner but factually the statement was incorrect and therefore, an appropriate application for early listing of the matter was filed before this court. On 04.09.2021, the application for early listing of the matter was allowed and the matter is directed to be listed before this court.

Learned Public Prosecutor today submits that the charge sheet though was prepared but was actually filed on 07.07.2021.

In the circumstances, learned counsel for the petitioner submits that he does not want to press the present Criminal Misc. Petition. However, the counsel seeks liberty for the petitioner to surrender before the trial court on or before 15.11.2021. He prays that the trial court may be directed to decide the application for regular bail on the same day including the submissions of bail bonds and he also prays that submission of bail bonds may also be considered by the trial court.

Accordingly, the criminal misc. petition is dismissed as not pressed.

However, since the investigation in the matter is already complete and custodial interrogation of the petitioner is not warranted, the trial court is directed to decide the application of the petitioner for grant of regular bail preferably on the same day including the prayer of the petitioner for acceptance of his bail bonds strictly in accordance with law.
