The present bail application has been filed under Section 439 Cr.P.C. on behalf of the petitioner, who is in judicial custody in connection with F.I.R. No.146/2019, Police Station Rawatsar, District Hanumangarh, registered for the offences punishable under Sections 458, 307, 336 and 504 read with Sections 109 and 195A read with Section 120-B of the Indian Penal Code.

Heard and considered arguments advanced by learned counsel for the petitioner and learned Public Prosecutor. Perused the material available on record.

Learned counsel for the petitioner stated that charge-sheet has been filed; benefit of bail has been granted to co-accused Bhajan Lal; petitioner is behind the bars since 22.04.2019; no

injury has been attributed to the petitioner; allegation under Section 307 has been levelled against the petitioner only on the basis of use of fire arms; statement of five witnesses have been recorded out of them, four witnesses turned hostile; and trial will take time. With these submissions, learned counsel for the petitioner prayed that the benefit of bail may be granted to the petitioner.

Per contra, learned Public Prosecutor has opposed the bail application and stated that there is an allegation of raiki against the accused-petitioner; video of firing by fire arms has been recorded by the accused-petitioner; and complainant supported the story of the prosecution.

In reply, learned counsel for the petitioner stated that the fire arms were used by the co-accused Bhajan Lal.

Having regard to the facts and circumstances of the case, particularly looking to the facts that charge-sheet has been filed; benefit of bail has been granted by co-ordinate Bench of this Court to co-accused Bhajan Lal vide order dated 27.07.2021 (Bail Application No.6792/2021); and trial will take sufficiently long time, therefore, without expressing any opinion on the merits/demerits of the case, this Court is of the opinion that the bail application filed by the petitioner deserves to be accepted.

Consequently, the bail application is allowed. It is ordered that the petitioner, Inderpal @ Monu S/o Subhash Chandra, arrested in connection with F.I.R. No.146/2019, Police Station Rawatsar, District Hanumangarh, shall be released on bail, if not wanted in any other case; provided he furnishes a personal bond of Rs.50,000/- with two surety bonds of Rs.25,000/- each to the satisfaction of the learned trial court with the stipulation to appear before that Court on all dates of hearing and as and when called upon to do so.
