The present second bail application has been filed under Section 439 Cr.P.C. on behalf of the petitioner, who is in judicial custody in connection with F.I.R. No. 112/2021, Police Station Nokha, District Bikaner, registered for the offences under Sections 447, 341, 323, 324, 325, 326 and 308/34 of the Indian Penal Code.

Heard and considered the arguments advanced by the learned counsel for the petitioner and learned Govt. Advocatecum-Additional Advocate General assisted by learned Public Prosecutor. Perused the material available on record.

Learned counsel for the petitioner stated that at the time of rejection of first bail application, liberty was granted to file fresh bail application after filing of the charge-sheet, now charge-sheet

has been filed; no grievous injury found on the vital part of the body of injured; accused-petitioner is behind the bars since 18.05.2021; charge-sheet has been filed; and further investigation and trial will take time. With these submissions, learned counsel for the petitioner prayed that the benefit of bail may be granted to the accused-petitioner.

Per contra, learned GA-cum-AAG assisted by Public Prosecutor has opposed the second bail application of the accused-petitioner and stated that fourteen other cases have been registered against the accused-petitioner. Learned GA-cum-AAG further stated that eleven injuries caused to injured Surja Ram but no injury was found on vital part of the body.

Having regard to the facts and circumstances of the case, without expressing any opinion on the merits/demerits of the case, this Court is of the opinion that the second bail application filed by the petitioner deserves to be accepted.

Consequently, the second bail application is allowed. It is ordered that the accused-petitioner Sukhram S/o Shri Ramnarayan, arrested in connection with F.I.R. No. 112/2021, Police Station Nokha, District Bikaner, shall be released on bail, if not wanted in any other case; provided he furnishes a personal bond of Rs.50,000/- and two surety bonds of Rs.25,000/each to the satisfaction of the learned trial Court with the stipulation to appear before that Court on all dates of hearing and as and when called upon to do so.
