The petitioner has been arrested in connection with FIR No.394/2018, registered at Police Station Balotra, District Barmer for the offence punishable under Section 8/15 NDPS Act. He preferred this application for interim bail under Section 439 Cr.P.C.

Heard learned counsel for the petitioner as well as learned Public Prosecutor and perused the material available on record.

Learned counsel for the petitioner submits that petitioner's father Kheraj Ram died on 08.05.2021 and due to lockdown, last rites and rituals could not be performed; petitioner being the eldest son seeks 10 days' interim bail to meet his mohter and family members and perform last rituals.

The fact of death of petitioner's father has been verified by police and learned Public Prosecutor has submitted copy of Death Certificate.

Having regard to the overall facts and circumstances of the case, particularly looking to the cause shown in the petition, it is ordered that the petitioner Ramniwas S/o Shri Kheraj Ram, arrested in connection with FIR No.394/2018, registered at Police Station Balotra, District Barmer shall be released on interim bail for a period of five days from the date of his actual release provided he executes a personal bond in the sum of Rs.1,000,00/with two sound and solvent sureties of Rs.50,000/- each to the satisfaction of the concerned trial court.

The Superintendent, Sub Jail – Balotra shall give the date of surrender of the accused-petitioner.

It is directed that the petitioner shall surrender himself positively on the date given by the Superintendent, Sub-Jail Balotra. In case petitioner does not surrender on the stipulated date, the incharge of the concerned jail shall intimate in this regard to the trial Court and the trial Court will act for securing presence of the petitioner as per law.
