Before this Court is an application under Section 439 Cr.P.C. preferred on behalf of petitioner who has been arrested in connection with FIR No.70/2021 registered at Police Station Sadulsahar, District Sriganganagar for the offences punishable under Sections 307, 323, 341, 147, 148, 149 IPC and 3/25 & 27 of Arms Act, 1959.

Learned counsel for the petitioner submits that the grievous injury of the Baljindra Singh is not attributable to the present petitioner; the allegation of firing was also not levelled against the petitioner; no other criminal case is pending against the present petitioner. Learned counsel for the petitioner prays to enlarge the petitioner on bail.

Learned Public Prosecutor and Learned counsel for the complainant opposed the grant of bail to the petitioner.

In the facts and circumstances of the case, without expressing any opinion on merits of the case, this Court deems it just and proper to enlarge accused-petitioner on bail under Section 439 Cr.P.C.

Accordingly, the bail application filed under Section 439 Cr.P.C. is allowed and it is directed that petitioner Balkaran Singh S/o Mithu Singh shall be released on bail in connection with FIR No.70/2021 registered at Police Station Sadulsahar, District Sriganganagar provided he executes a personal bond in the sum of Rs.1,00,000/- with two sound and solvent sureties of Rs.50,000/- each to the satisfaction of learned trial Court for his
