This application seeking anticipatory bail under Section 438 CrPC has been preferred by the petitioner apprehending his arrest in connection with FIR No.96/2020 registered at Police Station Kotwali, District Banswara for offences punishable under Sections 384 & 506 IPC.

Learned counsel for the petitioner submits that petitioner is not the main accused, he was cameraman only; investigation is completed; petitioner is innocent. Counsel for the petitioner prays for grant of anticipatory bail to the petitioner.

Learned Public Prosecutor opposes grant of anticipatory bail to the petitioner.

Having considered rival contentions of the learned counsel for the parties and material available on record, in the facts and circumstances of the case, without expressing any opinion on merits

of the case, this Court deems it just and proper to grant anticipatory bail to the accused-petitioner under Section 438 CrPC.

Accordingly, this bail application under Section 438 CrPC is allowed and it is ordered that in the event of arrest of petitioner Rajesh S/o Sh. Kanhaiya Lal Soni, in connection with FIR No.96/2020 registered at Police Station Kotwali, District Banswara shall be enlarged on bail provided he executes a personal bond in the sum of Rs.50,000/- (rupees fifty thousand) with one sound & solvent surety of Rs.25,000/-, to the satisfaction of concerned I.O./S.H.O. on the following conditions:

1. The petitioner shall make himself available for interrogation by the Investigation Officer as & when required;

1. The petitioner shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the court or to any Police officer;

1. The petitioner shall not leave India without prior permission of the court.
