This application for anticipatory bail under sec.438 CrPC has been filed by the petitioner apprehending his arrest in connection with FIR No.80/2020 registered at Police Station Ghantaghar, Udaipur for offences punishable under secs. 306 of IPC.

Heard learned counsel for the petitioner as well as learned Public Prosecutor and perused the material available on the record.

Learned counsel for the petitioner submits that no case is made out under Section 306 IPC against the petitioner. Learned counsel for the petitioner prays to grant the petitioner anticipatory bail.

Learned Public Prosecutor has opposed grant of anticipatory bail to the petitioner.

Having considered rival contentions of learned counsel for the parties and material available on record, in the facts and

circumstances of the case, without expressing any opinion on merits of the case, this Court deems it just and proper to grant anticipatory bail to the accused-petitioner under sec.438 CrPC.

Accordingly, this bail application under sec.438 CrPC is allowed and it is ordered that in the event of arrest of petitioner Umesh Kant Vyas S/o Shri Shobha Lal Vyas in connection with FIR No.80/2020 registered at Police Station Ghantaghar, Udaipur, he shall be enlarged on bail provided he executes a personal bond in the sum of Rs.50,000/- (rupees Fifty Thousand) with two sound & solvent sureties of Rs.25,000/- each, to the satisfaction of concerned I.O./S.H.O. on the following conditions:

1. He/she/they make himself/herself/themselves available for interrogation by the Investigation Officer as & when required;

1. He/she/they shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the court or to any Police officer;

1. He/she/they shall not leave India without prior permission of the court.
