This application seeking for anticipatory bail under sec.438 CrPC has been preferred by the petitioner apprehending his arrest in connection with FIR No. 291/2020 registered at Police Station Degana, District Nagaur for offences punishable under secs. 143, 341, 323, 325, 308 & 427 IPC.

Heard learned counsel for the petitioner as well as learned Public Prosecutor and perused the material available on the record.

Learned counsel for the petitioner submits that no active role has been attributed to the petitioner and he has falsely been implicated in the case. Learned counsel for the petitioner prays to allow this anticipatory bail.

Learned Public Prosecutor has opposed grant of anticipatory bail to the petitioner.

Having considered rival contentions of the learned counsel for the parties and material available on record, in the facts and circumstances of the case, without expressing any opinion on merits of the case, this Court deems it just and proper to grant anticipatory bail to the accused-petitioner(s) under sec.438 CrPC.

Accordingly, this bail application under sec.438 CrPC is allowed and it is ordered that in the event of arrest of petitioner Rewant Nath S/o Chhotu Nath in connection with FIR No.291/2020 Police Station Degana, District Nagaur, he shall be enlarged on bail provided he executes a personal bond in the sum of Rs.50,000/(rupees Fifty Thousand only) with two sound & solvent sureties of Rs.25,000/- each, to the satisfaction of concerned I.O./S.H.O. on the following conditions:

1. He shall make himself available for interrogation by the Investigation Officer as & when required;

1. He shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the court or to any Police officer;

1. He shall not leave India without prior permission of the court.
