The present anticipatory bail application has been filed under Section 438 Cr.P.C. in connection with FIR No.27/2021 registered at Police Station Kekri, District Ajmer for the offence(s) under Sections 143, 332, 353, 341, 506 of IPC and Sections 16(1)(G)(D) and Section 62 of Food Safety and Standard Act.

Counsel for the petitioners submits that petitioners have been wrongly implicated in this case. Similarly situated co-accused Anil Mittal has been enlarged on anticipatory bail by this Court and case of the petitioners is similar to him. Nothing is to be recovered from the petitioners. Learned counsel for the petitioners submits that petitioners have joined investigation as per direction of this Court.

Learned Public Prosecutor has opposed the anticipatory bail application.

Considering the contentions put-forth by the counsel for the petitioner and taking into account the facts and circumstances of the case and without expressing any opinion on the merits of the case, this court deems it just and proper to allow the anticipatory bail application.

Accordingly, the anticipatory bail application is allowed. The S.H.O/I.O/Arresting Officer, Police Station Kekri, District Ajmer in FIR No.27/2021 is directed that in the event of arrest of the petitioners Dashrath Sahu S/o Ramdev Sahu , Kailash S/o Ratanlal , Suresh S/o Bannalal , Aman Soni S/o Ramdev

Soni , Dhanraj S/o Rampal Nayak , Pritam S/o Vimal Prakash Jain , Ramamvtar S/o Ramdhan Chaudhary , Kailash Mali S/o Nandlal Mali , Shri Ram S/o Jagdish , Lokesh S/o Omprakash , Sintu Sahu S/o Bhairu Teli , Pradhan S/o Pirumali , Sanwra Patel S/o Rameshwar Patel and Amit Sahu S/o Omprakash Sahu they shall be released on bail, provided each of them furnishes a personal bond in the sum of Rs.50,000/with two sureties in the sum of Rs.25,000/- each to the satisfaction of the S.H.O/I.O/Arresting Officer of the concerned Police Station on the following conditions:-

(i) that the petitioners shall make themselves available for interrogation by a police officer as and when required;

(ii) that the petitioners shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the court or any police officer, and

(iii) that the petitioners shall not leave India without previous permission of the court.
