Heard learned counsel for the petitioner as well as learned Public Prosecutor and learned counsel for the complainant and perused the case diary.
Learned counsel for the petitioner submitted that the petitioner has filed this anticipatory bail application under Section 438 CrPC in connection with FIR No.137/2020 registered at Police Station Peelwa, District Nagaur for offence under Sections 384 & 306 IPC.
Learned counsel for the petitioner further submits that no case of Sections 306 & 384 IPC is made out. He has already joined the investigation so he may be enlarged on pre-arrest bail.
On the other hand, Mr. Mohd. Javed Gauri, learned Public Prosecutor has opposed the pre-arrest bail application and submitted the factual report dated 27.09.2021. By perusal of

factual report it reveals that there was some dispute of transaction of money between the petitioner and deceased Megharam. It is further reveal that suicide note of deceased Megharam has also been found and call details are also taken on record.
Considering the nature of allegation and the offences involved herein, this Court does not find the present case is not fit for grant of anticipatory bail during the pendency of the investigation.
Accordingly, this criminal misc. bail application under Section 438 Cr.P.C. is dismissed.
