The instant bail application under Section 439 CrPC has been preferred by the petitioners Mahesh @ Mahesh Kumar S/o Maniya @ Mani Singh and Mukesh Kumar S/o Kheta Ji, who are in custody in connection with the F.I.R. No.16/2020 registered at the Police Station Mandwa, District Udaipur for the offences under Sections 147, 148, 323, 302/149 IPC and 3/25 and 4/25 of the Arms Act.

Heard learned counsel for the parties and perused the material available on record.

As per the FIR, challan papers and the order rejecting bail, the allegation of firing fatal gun shot at the deceased Kali is against co-accused Maniya @ Mani Singh.

In this background and having regard to the entirety of the facts and circumstances of the case, I am inclined to grant indulgence of bail to the petitioners during trial.

Accordingly, the instant bail application under Section 439 CrPc is allowed. It is ordered that the accused-petitioners (1) Mahesh @ Mahesh Kumar S/o Maniya @ Mani Singh and (2) Mukesh Kumar S/o Kheta Ji arrested in connection with F.I.R. No.16/2020 registered at the Police Station Mandwa, District Udaipur shall be released on bail; provided each of them furnishes a personal bond of Rs.50,000/- and two surety bonds of Rs.25,000/- each to the satisfaction of the learned trial court with the stipulation to appear before that Court on all dates of hearing and as and when called upon to do so.
