The instant bail application under Section 439 CrPC has been preferred by the petitioner Bhim Raj S/o Munshi Ram, who is in custody in connection with the F.I.R. No.510/2020 registered at the Police Station Rawatsar for the offences under Sections 307, 382, 147, 148, 149, 427, 341, 342, 323, 365 IPC and Section 27 of the Arms Act.

Heard learned counsel for the parties and perused the material available on record.

There are cross cases between the parties. On going through the order rejecting bail as well as the FIR No.510/2020 registered at the Police Station Rawatsar against the petitioner, it is apparent that only superficial injuries were caused to the complainant of the present case. The FIR lodged against the petitioner came to be presented after delay of 17 hours, whereas

FIR No.508/2020 registered at the instance of the present petitioner is prompt.

In this background and having regard to the entirety of the facts and circumstances of the case, I am inclined to grant indulgence of bail to the petitioner during trial.

Accordingly, the instant bail application under Section 439 CrPc is allowed. It is ordered that the accused-petitioner Bhim Raj S/o Munshi Ram arrested in connection with F.I.R. No.510/2020 registered at the Police Station Rawatsar shall be released on bail; provided he furnishes a personal bond of Rs.50,000/- and two surety bonds of Rs.25,000/- each to the satisfaction of the learned trial court with the stipulation to appear before that Court on all dates of hearing and as and when called upon to do so.
